I'm signing this petition to demand justice for Senzo and the Meyiwa family. It's concerning to see the judge displaying bias by consistently favoring the defense team and not actively working towards ensuring justice in this case. Additionally, it's troubling that the judge seems to be testifying on behalf of the state witnesses. This undermines the fairness and integrity of the judicial process

I am signing because the values and the principles of South Africa's constitutional democracy are being brazenly violated in an open court by Judge Ratha Mokgoatleng (Judge Ratha), presiding over the Senzo Meyiwa Murder Trial, Case 636/10/2014.

I sincerely believe that Judge Ratha has deliberately ignored all evidence that showed that this case was botched from the very beginning; contaminated crime scene, sudden appearance of a bullet head of a 9mm pistol after the first responders testified in this court that they was never a bullet head behind the glass jars where they had looked.

Furthermore, the instigator that got the 5 accused of being accused in the death of Senzo Meyiwa, Constable Zungu who was ordered by the Judge Ratha to go to KwaZulu-Natal to fetch his handwritten draft statement he took of Tumelo Madlala. The shocking thing was Judge Ratha coming to court with an already written judgement where he without fear told the court that Mr. Zungu could not find his draft statements and that was it.
Question was, how did the judge know that information before the State submitted this information to the court which should have this information first hand in court.

The issue of the DNA results is already addressed in the petition.

I therefore believe that Judge Ratha is brazenly committing gross misconduct in how he is presiding over this matter. And I believe that he ought to be recused.

Im concerned by the way judge Mokguatleng conducts himself, he makes it obvious that he is impartial and he treats the defense advocates with disrespect, especially adv Mshololo. As a woman, I cringe everytime this happens.

I'm signing because of how we see the conduct of Judge Ratha as unfair and abusive; especially to the defence counsels and the accused.
The Judge and the State are running an unfair trial because they ambush the defense with the evidence that they don't know and are pressured to admit evidence on record.
This Rob VS Hepworth of 1928 that the Judge is always using, he is using it to abuse and interfere with the proceedings than to guide and ensure that everything is done accordingly.
We can see that Sections 9, 34 and 35 of the Constitutions are violated by both Judge Ratha Mokgwathleng, the state(NPA and SAPS).

I think there's a lot that's been deliberately ignored in the case. That includes cooking up evidence and not arresting all suspects in the case. Not to mention the behavior of the judge. His attitude towards the defence team and their witnesses leaves much to be desired.

Judge Mokgwathleng operates in court like he's above the law. He messes around with the dignity of his colleagues in full view of everyone watching thus discouraging the young ones from having interest in law. He's shown bias against the defence in such a very disrespectful manner. He's demonstrated such unprofessionalism particularly with his pen which seems like he's communicating hidden messages. He's shown inconsistencies whereby he'd do A unto prosecution & witnesses & ensures B unto the defence particularly with adv Mngomezulu's health against the witness who was known to be not well. He's confusing the defence with regards to the code of conduct e.g. reporting direct to the judge by the defence. Overlooks the failures by the prosecutor particularly in failing to have provided the entire necessary documentation & in time yet gets very rough with the defence where they fail. He pretends regularly not to have heard what he's clearly heard. Put words in witnesses mouths. Doesn't listen & cut the defence of like they're foolish. He's glaringly arrogant to the defence & encourages witnesses to disrespect the defence. I can go on & on...
